| kemaskini 3.57pm Mahkamah Rayuan hari ini mengumumkan Datuk Seri Zambry Abd Kadir sebagai menteri besar Perak yang sah.
Keputusan itu membatalkan penghakiman Mahkamah Tinggi Kuala Lumpur minggu lalu yang mengesahkan kedudukan asal Datuk Seri Mohammad Nizar Jamaluddin. Panel tiga hakim itu – yang telah mendengar hujah kedua-dua pihak di Putrajaya seharian semalam – sebulat suara menerima rayuan Zambry. Dalam penghakimannya, ketiga-tiga mereka berhujah bahawa hakim mahkamah tinggi Datuk Abdul Aziz Abd Rahim membuat kesilapan dalam keputusannya dan Sultan Perak layak melantik Zambry apabila Mohamad Nizar hilang majoriti dalam DUN. Pada 11 Mei lalu, mahkamah tinggi mengumumkan Mohamad Nizar sebagai menteri besar sah setelah digugurkan jawatan tersebut, awal Februari lalu. Abdul Aziz memutuskan bahawa wakil rakyat PAS itu tidak pernah mengosongkan jawatannya itu kerana beliau tidak kehilangan kepercayaan majoriti anggota DUN Perak. Dalam kes ini, Abdul Aziz berkata tiada undi tidak percaya telah diusulkan terhadap Mohamad Nizar. Tetapi kegembiraan menteri besar Pakatan Rakyat itu tidak kekal apabila Mahkamah Rayuan keesokannya membenarkan permohonan Zambry untuk menangguhkan keputusan mahkamah tersebut. Penangguhan keputusan mahkamah itu diberikan sementara menunggu selesai rayuan berhubung perkara tersebut hari ini. [Laporan penuh menyusul] |
